Welcome to the Billy websiteExternal Link, (the Website), which is owned and operated by the Electricity Authority (Authority, we, us, or our).  These Terms of Use explain the terms that apply to your use of the Website.

By accessing and using the Website you are deemed to confirm that you have read, understood and agreed to be bound by these Terms of Use and the Billy Privacy Policy.  If you do not agree to any part of the Terms of Use or Billy Privacy Policy, you must not access, or must immediately stop accessing, the Website.   

Our Privacy Policy provides further information about the personal information we collect when you use the Website or services.   

In some cases, your use of the Website may be subject to additional terms and conditions. Where there is any inconsistency or conflict between these Terms of Use and any applicable additional terms, the additional terms will prevail to the extent of that inconsistency or conflict. We recommend that you review any such additional terms carefully before using those services or features.

to obtain information in order to discover pricing or related business information about retailers (other than for your own private uses as an energy consumer); 

for the uploading, or sending of: 

unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," or any other form of solicitation or commercial exploitation; 

any material that contains software viruses or any harmful or destructive computer code, files or programs; or 

any material which infringes the rights of any person or which is unlawful in any other respect; 

in a way that infringes the intellectual property of any person;  

to access, use or copy any material or information on this website for any commercial purpose or for any purposes which are unlawful. In particular, you are not allowed to copy (whether by printing off, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or use any material contained in this website except that you may print off any individual page for your own private use; or 

in breach of any applicable law or for any unlawful act.  

Limitation of liability    

The Website provides an information service to assist with comparing certain energy services on the basis of certain criteria and information we receive.  The services quoted and compared are not necessarily representative of all products and services available in the New Zealand market.  

While we have taken reasonable steps to ensure the information on the Website (including information supplied by retailers or other third parties) is accurate, errors and omissions may occur and we do not warrant or guarantee that information on the Website is accurate, complete, up to date or suitable for your intended use.  Please let us know if you spot an error. 

We may use the information you provide us to assist with generating a comparison.  You must ensure that the information you provide us is accurate and up to date.  

Any comparison of a plan or service is an indicative guide only and not a formal offer or quote. All information on our Website is for general information purposes only and is not intended as a personal recommendation or advice about the suitability of a particular service for you.   

Before acting on the information provided by the Website, you should evaluate your own individual requirements and if necessary obtain independent advice before making a decision to sign up to a service.  We recommend you confirm any specific details about a plan or service directly with the relevant retailer before making a decision.

When Billy finds comparison plans you can ‘Add info to profile’. These comparison plans are based on pricing information from retailers and estimated usage assumptions and the additional information helps Billy refine the comparisons. In the Add info to profile feature you may also select a “time-of-use” estimation (e.g. if you would consider shifting electricity usage to cheaper off-peak periods). Note that even with this additional information, comparison results may differ from actual prices, which depend on your specific circumstances and retailer-specific promotions. You should confirm the current price and plan terms directly with the retailer.   

Your use of and access to the Website is at your own risk.  To the extent permitted by law, and subject to clause 5.9: 

the Website is provided on an “as is” and “as available” basis and any warranties, representations, conditions, undertakings and terms, whether express or implied, are expressly excluded; and 

in no event will we be liable to you, or any third party, under contract, tort (including negligence) or otherwise, under or in connection with these Terms of Use for your access to, use of, inability to use or reliance on the Website or any information contained in or accessed through the Website. 

You acknowledge that access to the Website is provided at no charge and accordingly the exclusions of liability set out in this clause are fair and reasonable. 

Nothing in these terms affects any applicable rights you have under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 (unless you are using the Website for business purposes, in which case you acknowledge that the provisions of those Acts will not apply).  

The Website may contain links to other internet sites provided by third parties. The provision of any of these links does not represent an endorsement by the Authority of those internet sites, nor does the Authority make any representations or warranties as to the accuracy, completeness, performance or timeliness of any aspect of information contained in those third party internet sites. The Authority expressly excludes liability for any such inaccuracies or errors on other third party internet sites to the fullest extent permitted by law.

Copyright material on this website is protected by copyright owned by the Authority on behalf of the Crown. 

You may access and use this Website solely for your own personal, non-commercial purposes, provided that you do not remove, alter, or obscure any copyright, trade mark, or other proprietary notices displayed on the Website or its content.  Except as expressly permitted by us in writing, you must not copy, modify, distribute or display, or create derivative works from any part of this Website.  We grant you a limited, revocable, non-exclusive, and non-transferable licence to access and use the Website and our services strictly for your own personal, non-commercial use and only to the extent necessary for your use of the Website and our services.    

Without limiting clause 6.2, the following may not be re-used without express written permission from us, or if the copyright is a third party’s, by that copyright owner:

Use of AI

Our comparison service uses artificial intelligence to analyse the information you provide alongside available plan data from retailers, in order to generate plan and service comparisons for your consideration. The AI model processes this data to identify and present comparisons based on your inputs; it does not make decisions on your behalf.

General  

All amounts stated on the Website are in New Zealand dollars and inclusive of GST. 

These Terms of Use and the Billy Privacy Policy constitute the entire agreement between you and us relating to the Website.  

Our failure to exercise, or delay in exercising, any right will not be deemed a waiver of that right or any other rights that we may have. 

If you access the Website from outside New Zealand you are responsible for compliance with any applicable laws of that jurisdiction.   

These Terms of Use are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
